Cuba has revised its foreign investment regulations to relax business restrictions on branches of foreign enterprises.

On October 2, the Government of Cuba promulgated Decree No. 183/2026, which revises the administrative regulations on foreign commercial representative agencies implemented since 2021. It officially allows registered branches of foreign enterprises in Cuba to directly engage in commercial import and export, issue commercial invoices, distribute and transport goods within the territory of Cuba, and carry out wholesale business. Nevertheless, the branches are still prohibited from engaging in ordinary retail business, and their import and export operations must still comply with the authorization of the Ministry of Foreign Trade and Foreign Investment and the allocation procedures for the commodity import and export catalogue. In addition, institutions in the nature of commercial representative offices are still subject to the original restrictions, and may not directly engage in import and export, distribution, or wholesale and retail operations. If a commercial representative office or branch intends to carry out retail or investment activities in Cuba, it must establish a wholly foreign-owned enterprise in accordance with the law.
