The Ministry of Commerce issued an announcement on February 12, announcing the final ruling of the countervailing investigation on imported related dairy products originating from the European Union. It was decided that starting from February 13, 2026, countervailing duties will be imposed on imported related dairy products originating from the European Union.
The spokesperson of the Ministry of Commerce responded on the same day, stating that at the request of the domestic industry, the Ministry of Commerce launched a countervailing investigation on imported related dairy products originating from the European Union on August 21, 2024. The Ministry of Commerce conducted the investigation in strict accordance with relevant Chinese laws and regulations and relevant rules of the World Trade Organization, adhering to the principles of fairness, impartiality, openness, and transparency. It widely listened to the opinions of all interested parties and fully guaranteed the rights of all parties, thus forming an objective and fair investigation conclusion.
The spokesperson said that the ruling report shows that there are subsidies for imported related dairy products originating from the European Union, which have caused material damage to the relevant industries in China, and the causal relationship between the subsidies and the material damage is established. The Ministry of Commerce issued a final ruling announcement on February 12, 2026, ruling that the tax rates for EU companies range from 7.4% to 11.7%, and decided to implement countervailing measures starting from February 13, 2026, with an implementation period of 5 years.
According to the announcement, the relevant dairy products specifically include fresh cheese (including whey cheese) and curd, etc., which are mainly used as food for direct or processed consumption by humans. (Ministry of Commerce)
